RIBO 核心:Negligence 四要素
先记住一个最重要的公式:
Duty → Breach → Causation → Damage
有义务 → 没做到 → 导致损害 → 才可能构成 Negligence
可以把它理解成:
“我本来应该做什么?” → “我有没有做到?” → “我的行为是不是造成了损失?” → “对方到底有没有实际损害?”
① Duty of Care — 注意义务 ⭐⭐⭐⭐⭐
什么是 Duty of Care?
就是:
法律要求某个人在合理情况下,对另一个人的安全或财产承担合理注意义务。
最简单的例子:
一家超市对进入店里的顾客,通常需要合理地维护店内环境,避免顾客因为明显危险而受伤。
例如地板上有水:
Supermarket → Customer
超市可能对顾客负有 Duty of Care。
⚠️ 但有 Duty 不代表已经 Negligent
这是考试非常重要的一点。
假设:
超市对顾客有 Duty of Care。
这只是第一步。
还要继续问:
Did the supermarket breach that duty?
② Breach of Duty — 违反注意义务 ⭐⭐⭐⭐⭐
Breach 就是:
没有做到一个合理谨慎的人在相同情况下应该做到的程度。
关键词:
Reasonable Person
考试经常会出现:
What would a reasonable person have done under similar circumstances?
例子
超市发现地板漏水。
合理做法可能是:
- 清理
- 放置警示牌
- 隔离危险区域
- 尽快处理
如果什么都不做:
顾客随后滑倒
那么就可能存在:
Breach of Duty
③ Causation — 因果关系 ⭐⭐⭐⭐⭐
这是最容易被陷阱题骗的地方。
即使:
有 Duty
有 Breach
也不代表一定要赔钱。
必须证明:
Breach 导致了损害。
通常可以用一个非常简单的方法理解:
“But for” test
问:
如果没有这个过失,损害还会发生吗?
例如:
超市没有清理地上的水。
John 因为水滑倒。
如果:
没有那滩水 → John 就不会因为它滑倒
那么因果关系比较明确。
④ Damage — 实际损害 ⭐⭐⭐⭐⭐
最后必须有:
实际的损害或损失。
例如:
- Bodily injury
- Property damage
- 某些情况下的其他可赔损失
如果只是:
“超市地上有水,但没人摔倒,也没有损失。”
那么:
虽然可能存在安全问题,
但要成立一个可赔的 negligence claim,通常还缺少:
Damage

陷阱 1:有 Accident ≠ 有 Negligence
例如:
John 在商店里突然被一个掉下来的物品砸到。
发生了 Accident。
但你不能马上说:
Store is negligent.
必须继续调查:
- Store 有没有 Duty?
- 有没有 Breach?
- Breach 是否造成损害?
- 有没有 Damage?
陷阱 2:有 Duty ≠ 有 Negligence
例如:
商店对顾客有 Duty of Care。
这只是第一步。
Duty alone ≠ Negligence
陷阱 3:有 Breach ≠ 自动赔偿
例如:
商店违反了安全规定。
但是:
没有人受伤,也没有财产损失。
那么还要问:
Where is the Damage?
陷阱 4:有 Damage ≠ 对方一定负责
例如:
John 在商店里摔倒,受伤了。
这确实有:
Damage
但还要证明:
Store’s Breach caused the injury.
如果 John 是因为自己的医疗问题突然失去平衡,而不是因为商店的过失:
可能缺少:
Causation
⭐ 另外一个非常重要的概念:Standard of Care
这个跟 Breach 紧密相关。
判断有没有 Breach,通常会问:
一个 reasonable person 在类似情况下会怎么做?
例如:
普通司机:
雨天应该降低速度、保持合理距离。
如果司机在暴雨中高速驾驶并撞车:

如果答案是 Yes,而商场没有做:

这个特别容易出陷阱。
意思大致是:
这种损害是否属于在当时情况下可以合理预见的风险?
例如:
商店知道地板有大量积水,却不处理。
顾客滑倒受伤:
这种结果具有一定的可预见性。
但如果发生一个完全异常、无法合理预见的事件,因果关系和责任分析就会复杂很多。

Negligence
需要进一步证明:
